Terms and Conditions

Compliance with Philippine E-Commerce Act (RA 8792) and Consumer Act (RA 7394)

By accessing or using Daet Massage and Spa services, you agree to:

  • Data synchronization and backup services
  • Technical support and updates

4. User Accounts and Registration

4.1 Account Creation

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account
  • You must notify us immediately of any unauthorized access
  • You are responsible for all activities under your account

4.2 Account Verification

We may require verification of your identity and business registration in compliance with Philippine regulations.

5. Pricing and Payment Terms

5.1 Pricing

  • All prices are displayed in Philippine Pesos (PHP)
  • Prices are inclusive of applicable Value Added Tax (VAT) unless otherwise stated
  • We reserve the right to modify prices with 30 days notice

5.2 Payment Methods

We accept the following payment methods:

  • Credit/Debit Cards (Visa, Mastercard)
  • Online Banking
  • E-wallets (GCash, PayMaya)
  • Bank Transfer/Deposit

5.3 Billing

  • Subscription fees are billed in advance
  • Official receipts will be issued for all payments
  • Late payments may result in service suspension

6. Consumer Protection Rights

  • Right to Safety: Protection against products and services hazardous to health and safety

7. Warranties and Representations

7.1 Service Warranty

We warrant that our services will:

  • Perform substantially as described in our documentation
  • Be provided with reasonable skill and care
  • Comply with applicable Philippine laws and regulations

7.2 Remedies

If our services fail to meet these warranties, we will:

  • Repair or re-perform the services at no additional cost
  • Provide a refund if we cannot fix the issue within 30 days

8. Refund and Cancellation Policy

8.1 Cooling-Off Period

In accordance with DTI regulations, you have a 7-day cooling-off period from subscription date to cancel without penalty.

8.2 Refund Policy

  • Full refund within 7 days of purchase if service is unused
  • Pro-rated refund for prepaid periods after 7 days
  • No refund for consumed services or after 30 days
  • Refunds processed within 15 business days

8.3 Cancellation

  • You may cancel subscription anytime with 30 days notice
  • Cancellation takes effect at end of current billing period
  • Data export available for 60 days after cancellation

9. Intellectual Property Rights

9.1 Ownership

  • All software, content, and materials remain our property
  • You receive a limited, non-exclusive license to use our services
  • You retain ownership of your business data

9.2 Restrictions

You may not:

  • Copy, modify, or create derivative works
  • Reverse engineer or decompile the software
  • Remove copyright or proprietary notices
  • Resell or sublicense the services

10. Limitation of Liability

To the maximum extent permitted by Philippine law:

  • Our total liability shall not exceed the amount paid by you in the last 12 months
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for loss of profits, data, or business opportunities
  • These limitations do not apply to gross negligence or willful misconduct

11. Indemnification

You agree to indemnify and hold harmless Daet Massage and Spa from any claims arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your use or misuse of our services
  • Your business operations using our platform

12. Electronic Transactions

In accordance with the E-Commerce Act (RA 8792):

  • Electronic documents and signatures are legally valid
  • You consent to receive electronic communications
  • Electronic records satisfy legal requirements for written documents
  • We maintain secure electronic transaction records

13. Dispute Resolution

13.1 Mediation

Disputes shall first be submitted to mediation under DTI's mediation procedures.

13.2 Arbitration

If mediation fails, disputes shall be resolved through arbitration under the Philippine Dispute Resolution Center, Inc. (PDRCI) rules.

13.3 Governing Law

These Terms are governed by the laws of the Republic of the Philippines.

13.4 Jurisdiction

14. Force Majeure

We shall not be liable for delays or failures due to causes beyond our reasonable control, including but not limited to:

You may terminate by canceling your subscription and ceasing use of services.

  • Harm to other users or our systems

18. Severability
